Contract - landscape design - upfront +% of tender +backout

Contract - landscape design - hourly rate upfront backout

This Service Contract is for a contractor to work on a landscape design to go to tender, assist in awarding the tender, and assist in project management; to be completed by a given time (the 'term') and to be paid a set fee for a given number of hours within that term. It requires an initial payment to get the job under way and has a 'backout clause' which allows the Client to cancel within 30 days, but, after this date, both sides are committed to completing the job as agreed.

Legal Terms of Lodgement

One of the first documents you find in a Tender is a declaration to be bound by the contents of the tender (the Terms of Lodgement) (often called a B1 because it is often the first thing to appear in the Schedules attached to the Formal Tender). It identifies the person making the declaration, their legal relationship to the Tenderer, their legal ability to bind the Tenderer and the Terms of that binding that can be assumed upon lodgement.

Deed of Tender (attach to tender)

Lodgement under seal. A legal document accompanying the Tender often used to guarantee products, services and/or prices on offer in the accompanying Tender. This is a simple example, just guaranteeing the price; two Options, with or without a Capital Works Programme. This is the only place the price of the offer is mentioned in the tender document, allowing it to be removed from the front to allow the rest of the tender to be processed by players at the lodgement office assessing the value of the tender who do not need to know the final price.
