The issuer asks the tenderer's agent to tell him/her the legal nature of the assignment that will legally bind the tenderer, defines four SMETypes and six company types and then asks questions particular to those types. Fully worked with conditions applicable to a major project with a preference for an instument of delegation by the tenderer's board of directors (or otherwise things start getting complicated). It requires confidentiality agreement (issuer to tenderer) nomination format before due diligence can begin and requires any subby that the tenderer wants involved in due diligence to be identified by confidentiality declaration (NSW) by the tenderer. The subby will also need to sign a confidentiality agreement.
Often in Australia these days the Contract is sent out with the RFT so that there can be no misunderstanding regarding the final legal relationship required if the Tender is accepted.
The Request for Tender (RFT) is usually sent to a potential vendor following a formal reply by the vendor to a public advertisement. The RFT calls for offers from vendors based on a written specification of the required goods and/or services.
