Request for Tender (RFT) - Major project (QLD)

A standard RFT for a major (QLD) project. Fully worked with conditions applicable to a major project with a preference for an instrument of delegation by the tenderer's board of directors (or otherwise things start getting complicated). It requires confidentiality agreement (nomination format) before due diligence can begin and requires any subby that the tenderer wants to be included in due diligence to be identified by statutory declaration by the tenderer. The subby will also need to sign a confidentiality agreement. It ties any subby involved in due diligence to one tenderer only.

It requires considentiality agreement (nomination format) before due diligence can begin and requires any subby that the tenderer wants to be involved in due diligence to be identified by confidentiality declaration by the tenderer. The subby will also need to sign a confidentiality agreement.

Deed of Tender (attach to tender)

Lodgement under seal. A legal document accompanying the Tender often used to guarantee products, services and/or prices on offer in the accompanying Tender. This is a simple example, just guaranteeing the price; two Options, with or without a Capital Works Programme. This is the only place the price of the offer is mentioned in the tender document, allowing it to be removed from the front to allow the rest of the tender to be processed by players at the lodgement office assessing the value of the tender who do not need to know the final price.

Deed Poll - Confidentiality Declaration supplied by subbie

Any state in Australia. A sub-contractor employed under a separate contract with the Contractor signs under Deed Poll an undertaking to keep confidential information supplied to him/her for work under the original Contract between the Principal and the Contractor. This is an interesting document. It uses the Deed Poll format so that the subbie can sign it without the need for formal sign off of three way agreements between the subby and the other two parties which are a hassle to obtain and provide little more than the Deed Poll.
