This Service Contract is for a contractor to work on a website design project to be completed by a given time (the 'term') and to be paid for a given number of hours within that term. An initial payment is required to get the job under way and a 'backout clause' allows the Client to cancel within 30 days, but, after this date, both sides are committed to completing the job as agreed. For small jobs 100% is required up front. There are specific clauses related to website design, trademark and copyright and suggested appendices detailing the website design process.
Many organisations are suffering the legacy of poorly performing ERP systems as a result of implementation projects failing, shortcuts taken during implementation, poor data migration, systems and processes not matching, poor software evaluation & selection, misinformation or lack of knowledge on what the ERP system is supposed to do. The company has paid the money and have sunk the costs into the technology and irrespective of what other actions are taken to recover monies, the fact remains value has to be obtained from the system.
